1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and RESCUE DOG .ME ("Organization," "we," "us," or "our"), a Wyoming-based nonprofit animal rescue organization. These Terms govern your access to and use of our website located at rescuedog.me (the "Site"), as well as any services, programs, forms, events, or activities we offer (collectively, the "Services").

By accessing the Site or using any Service in any manner — including browsing, submitting an application, attending an event, volunteering, or fostering or adopting an animal — you affirm that you are at least 18 years of age and legally capable of entering into a binding contract, and that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to the Site. Your continued use of the Site or Services after any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Use of the Site and Services

Permitted Use

You may use the Site and Services for lawful, personal, non-commercial purposes consistent with these Terms. Permitted uses include browsing available animals, submitting adoption or volunteer applications, reading our policies, and contacting us through our provided forms.

Prohibited Conduct

You agree not to use the Site or Services to:

• Violate any applicable local, state, federal, or international law or regulation.
• Submit false, misleading, fraudulent, or incomplete information on any application or form.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Scrape, crawl, harvest, or systematically collect data from the Site without our prior written consent.
• Introduce any virus, malware, or other harmful code to the Site.
• Attempt to gain unauthorized access to any portion of the Site or its related systems.
• Use automated tools, bots, or scripts to access, interact with, or submit forms on the Site.
• Engage in any conduct that disrupts, interferes with, or places an unreasonable burden on the Site or its infrastructure.
• Use information obtained from the Site to harass, threaten, or harm any person or animal.
• Re-sell, transfer, or commercially exploit any Service or information obtained through the Site.

We reserve the right, in our sole discretion, to refuse, suspend, or terminate your access to the Site or Services for any violation of these Terms or for any other reason without notice or liability.

3. No Guarantee of Services or Placement

RESCUE DOG .ME does not guarantee that any particular animal will be available for adoption or foster, that any application will be approved, or that any specific Service will be available at any given time. All animal placements are made at our sole discretion. Submission of an application does not create an obligation on our part to approve, respond within a specific timeframe, or place any animal. We reserve the right to decline, withdraw, or cancel any placement at any time for any reason we deem appropriate in the best interest of the animal.

Waiting lists, scheduling, event availability, and program capacity are subject to change without notice.

4. Animal Health, Behavior, and Risk Disclaimer

All animals available through RESCUE DOG .ME are rescue animals. You acknowledge and agree to the following:

• Unknown history: Many animals in our program have unknown or incomplete behavioral, medical, or social histories. We cannot verify or warrant the accuracy of any information provided to us by prior owners, shelters, or partners.
• Inherent unpredictability: Animals are living beings with inherently unpredictable behavior. Even animals that have been assessed, socialized, and observed may behave unexpectedly in new environments or situations.
• No warranty of temperament or health: We make no representation or warranty, express or implied, regarding any animal's temperament, trainability, compatibility with children, other animals, or specific living situations, or freedom from disease, parasites, genetic conditions, or behavioral issues — known or unknown at the time of placement.
• Assumption of risk: You voluntarily assume all risks associated with interacting with, transporting, fostering, or adopting any animal through our organization, including but not limited to the risk of bites, scratches, property damage, injury, illness, and death.
• Veterinary care: Any veterinary information, health records, or assessments we provide are based on records available to us and are not a substitute for independent veterinary examination. You are solely responsible for obtaining any veterinary care you deem appropriate following placement.

5. Disclaimers of Warranty

THE SITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RESCUE DOG .ME EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.
• WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, CURRENCY, OR RELIABILITY OF ANY CONTENT ON THE SITE, INCLUDING ANIMAL PROFILES, DESCRIPTIONS, PHOTOGRAPHS, AND ASSESSMENTS.
• WARRANTIES REGARDING ANY ADVICE, RECOMMENDATIONS, OR INFORMATION PROVIDED BY OUR STAFF, VOLUNTEERS, OR PARTNERS.

Animal profiles, photographs, descriptions, and behavioral notes are provided for informational purposes only and are not representations or warranties of any kind. Photographs may not reflect the animal's current appearance, condition, or size.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RESCUE DOG .ME, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AGENTS, PARTNERS, CONTRACTORS, OR REPRESENTATIVES (COLLECTIVELY, "RELEASED PARTIES") BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY;
• PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH;
• COST OF SUBSTITUTE GOODS OR SERVICES;
• DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES;
• DAMAGES ARISING FROM ANY ANIMAL PLACED THROUGH OUR ORGANIZATION;
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. IN ALL OTHER CASES, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

7. Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Site or Services;
• Your adoption, fostering, transport, or care of any animal placed through our organization;
• Any breach of these Terms by you;
• Any violation of any law or regulation by you;
• Any false, inaccurate, or misleading information you provided to us;
• Any negligence or willful misconduct by you;
• Any injury, damage, or harm caused by any animal in your care or custody;
• Any claim by a third party arising from your use of a placed animal.

We reserve the right to assume exclusive control of any matter subject to indemnification by you, at your expense. You agree to cooperate fully with our defense of any such claim.

8. Volunteer and Event Participation

Participation as a volunteer, transport driver, event helper, foster family, or in any other unpaid capacity with RESCUE DOG .ME is entirely voluntary and at your own risk. You acknowledge that:

• Volunteer activities may involve physical exertion, animal handling, driving, and other activities that carry inherent risks of injury.
• You are not an employee of RESCUE DOG .ME and are not entitled to compensation, benefits, or workers' compensation through our organization.
• You assume all risk of injury, illness, property damage, or other loss arising from your volunteer activities.
• RESCUE DOG .ME is not responsible for any costs, medical expenses, or other losses you incur while volunteering.

Event attendees, including those attending adoption events, puppy therapy, or puppy yoga events, also participate at their own risk and assume all risks associated with interacting with animals at such events.

9. User-Submitted Content

If you submit any content to us — including application information, photos, messages, testimonials, or any other material — you represent and warrant that:

• You own or have the right to submit such content.
• The content is truthful and accurate to the best of your knowledge.
• The content does not violate any law or the rights of any third party.

By submitting content to us, you grant RESCUE DOG .ME a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, and distribute such content in connection with our mission and promotional activities, unless you request otherwise in writing. We reserve the right to remove or decline any content at our discretion.

10. Third-Party Links and Services

The Site may contain links to third-party websites, social media platforms, payment processors, and other external resources. These links are provided for convenience only. We do not control, endorse, or assume any responsibility for the content, privacy practices, or availability of any third-party site. Your use of any third-party site is governed by that site's own terms and policies. We shall not be liable for any loss or damage arising from your use of any third-party site or service accessed through our Site.

References to any product, service, organization, or individual on the Site do not constitute or imply endorsement, recommendation, or approval by RESCUE DOG .ME.

11. Intellectual Property

All content on the Site — including text, graphics, photographs, logos, icons, audio clips, and software — is the property of RESCUE DOG .ME or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Site without our prior written consent.

Nothing in these Terms grants you any right, title, or interest in our name, logo, trademarks, or other intellectual property.

12. Donations

Any monetary donations made to RESCUE DOG .ME are voluntary and non-refundable unless required by law. Donations do not entitle the donor to any specific animal, service, placement, or outcome. RESCUE DOG .ME retains full discretion over how donated funds are used in furtherance of our mission. Tax deductibility of donations depends on your individual tax situation; we are not responsible for providing tax advice, and you should consult a qualified tax professional regarding deductibility.

13. Governing Law and Dispute Resolution

These Terms and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles.

Any legal action or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in Fremont County, Wyoming, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.

BEFORE INITIATING ANY LEGAL ACTION, YOU AGREE TO PROVIDE WRITTEN NOTICE TO RESCUE DOG .ME DESCRIBING THE DISPUTE IN REASONABLE DETAIL AND AFFORD US 30 DAYS TO ATTEMPT INFORMAL RESOLUTION. FAILURE TO PROVIDE SUCH NOTICE SHALL BE A BASIS FOR DISMISSAL OF ANY CLAIM.

To the extent permitted by applicable law, any claim or cause of action arising out of or related to these Terms must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred, notwithstanding any statute of limitations to the contrary.

14. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any default shall not constitute a waiver of any subsequent default.

15. Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements you enter into with us (such as an Adoption Agreement, Foster Care Agreement, or Volunteer Agreement), constitute the entire agreement between you and RESCUE DOG .ME with respect to your use of the Site and Services, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.

In the event of any conflict between these Terms and any other agreement you have entered into with us, the more specific agreement shall control with respect to its subject matter.
